AI in Hungary: the rules, the readiness and where to start

    Last checked: 29 October 2026

What should a company in Hungary know before starting with AI?

Hungary applies the EU GDPR, Act CXII of 2011 (Infotv.), and the EU AI Act. Act LXXV of 2025 and Government Decree 344/2025 set up the national AI authorities: the minister responsible for enterprise development supervises the market, and the National Accreditation Authority handles notified bodies. A company should map where its AI makes decisions about people and check whether any system is high-risk.

    Why now

    Why Hungary is worth watching

Each point links to the document it comes from.
    • Eurostat reports that 10.37% of Hungarian enterprises with 10 or more staff used AI in 2025, against an EU average of 19.95%.[1]

    • Parliament adopted Act LXXV of 2025 on 21 October 2025, and it was promulgated on 31 October 2025. It applies to AI whose output is used in Hungary, even if the provider is abroad.[7]

    • The act's provisions on an AI regulatory sandbox, run by the market surveillance authority, took effect on 2 August 2026.[7]

    • The act created a Hungarian Artificial Intelligence Council to support consistent application of the rules, chaired by the government commissioner for AI.[8]

    • A renewed AI strategy for 2025 to 2030 was announced in September 2025, with a target of one million AI-supported jobs by 2030, according to a press report of the ministry's statement.[10]

    The rules

The rules that matter for AI

What each law or policy means when you build or buy an AI system.

General Data Protection Regulation (EU) 2016/679 and Act CXII of 2011 (Infotv.)

In force2011People have a right not to be subject to a decision based solely on automated processing with legal or similarly significant effects, with exceptions for contracts, law and explicit consent (GDPR Article 22). High-risk processing needs a data protection impact assessment first, and breaches go to the NAIH within 72 hours where feasible. GDPR fines can reach EUR 20 million or 4% of worldwide turnover.[2]

EU Artificial Intelligence Act, Regulation (EU) 2024/1689, as amended by Regulation (EU) 2026/1744

Phased2024Bans on certain AI practices have applied since 2 February 2025 and rules for general-purpose AI models since 2 August 2025. Most other rules, including transparency duties, apply from 2 August 2026. The Digital Omnibus on AI, adopted and in force since 27 July 2026, moved high-risk rules to 2 December 2027 for Annex III uses such as hiring and credit, and to 2 August 2028 for AI in regulated products.[4]

Act LXXV of 2025 on the implementation in Hungary of the EU regulation on artificial intelligence

In force2025It entered into force on the 31st day after promulgation on 31 October 2025, with the sandbox provisions from 2 August 2026. The act lets the market surveillance authority impose AI Act fines, and Decree 344/2025 lets it settle cases by written agreement. Supervision of high-risk AI used directly for financial services stays outside its remit and with the financial sector rules.[7]

Government Decree 344/2025 (X. 31.) implementing Act LXXV of 2025

In force2025It names the minister responsible for enterprise development as the AI market surveillance authority and single point of contact, and the National Accreditation Authority as the notifying authority. Other authorities act only where a law gives them the task.[8]

    Where AI fits first

    Where AI fits first

    Automotive and manufacturing

Visual quality inspection, predictive maintenance and production planning.

AI built into products covered by EU product law, such as machinery, falls under high-risk rules from 2 August 2028.[4]

    Banking and insurance

Document checks, fraud alerts and Hungarian-language customer service, with staff reviewing any refusal.

Act LXXV of 2025 leaves high-risk AI used directly to provide financial services outside the general AI authority's market surveillance. Credit scoring is high-risk from 2 December 2027.[7]

    Shared service centres

Invoice processing, ticket triage and multilingual support drafting.

Where staff are monitored or assessed by AI, GDPR Article 22 and a data protection impact assessment are the first checks.[2]

    Your first steps

    Your first steps

    1. List every AI tool in use and note which ones make or shape decisions about people.
    2. Check each use against the AI Act bans and the Annex III high-risk list, and plan for the 2 December 2027 and 2 August 2028 dates.
    3. Run a data protection impact assessment before AI touches credit, hiring, health or monitoring of staff.
    4. Label chatbots and AI-generated content where the AI Act transparency rules require it.
    5. Give staff basic AI training, which the amended AI Act asks providers and deployers to support.
    6. If you want to test a new AI product under supervision, look at the AI sandbox run by the market surveillance authority.
    7. Keep a breach process that can reach the NAIH within 72 hours.

    Questions

Common questions about AI in Hungary

Does Hungary have its own AI law?

Yes. Act LXXV of 2025 implements the EU AI Act in Hungary and has been in force since December 2025. It sets up authorities, procedures and a sandbox; the main duties still come from the EU AI Act.

    Who supervises AI in Hungary?

Under Decree 344/2025, the minister responsible for enterprise development is the market surveillance authority and single point of contact. The National Accreditation Authority is the notifying authority. The NAIH still supervises personal data.

Does the law apply to a provider outside Hungary?

Yes, where the AI output is used in Hungary. Act LXXV of 2025 covers providers and deployers in third countries in that case.

When do the high-risk AI rules start?

After the EU Digital Omnibus on AI, from 2 December 2027 for Annex III uses such as hiring, education and credit, and from 2 August 2028 for AI in regulated products. Breaches of the bans can already bring fines of up to EUR 35 million or 7% of worldwide turnover.
