AI in Argentina: the rules, the readiness and where to start

    Last checked: 29 October 2026

What should a company in Argentina know before starting with AI?

Argentina has no AI law as of 29 October 2026. The Personal Data Protection Law, Law 25.326 of 2000, applies to any AI that uses personal data, and the data authority AAIP has published guidance on responsible AI. Expect stricter rules over time: Argentina has approved Convention 108+, and several bills to replace Law 25.326 or regulate AI have been filed in Congress.

    Why now

    Why Argentina is worth watching

Each point links to the document it comes from.
    • In September 2024 the AAIP published a guide for public and private bodies on using AI responsibly. It recommends an impact assessment before deploying AI that handles personal data.[4]

    • AAIP Resolution 161/2023 created a programme on transparency and data protection in AI, with an observatory, an expert council and good-practice guides.[3]

    • Law 27.699, published on 30 November 2022, approved Convention 108+. The government says it brings incident reporting, biometric and genetic data as sensitive data, and updated transfer rules.[2]

    • Disposición 2/2023 set out recommendations for trustworthy AI in public sector projects, covering each stage of an AI project.[5]

    • Bills to replace Law 25.326 and to regulate AI were filed in both chambers of Congress in 2025. An earlier AAIP draft data law lapsed at the end of 2024.[6]

    The rules

The rules that matter for AI

What each law or policy means when you build or buy an AI system.

Personal Data Protection Law, Law 25.326

In force2000Processing needs free, express and informed consent, usually in writing, unless an exception applies (article 5). Sending data to a country without adequate protection is prohibited, with narrow exceptions (article 12). Court and administrative decisions that assess a person's conduct cannot rest only on automated processing (article 20).[1]

Law 25.326: registration, sensitive data and sanctions

In force2000Certain databases must be registered with the authority, stating their purpose, data types and security measures (article 21). Health data is sensitive data (article 2). Sanctions include warnings, suspension, fines and closure of the database (article 31); the peso amounts in the original text are dated, so check current AAIP rules.[1]

Convention 108+, approved by Law 27.699

In force2022Argentina has approved the modernised Council of Europe data protection convention. The government's summary says it adds incident reporting and stricter rules on minimisation and children's data. How far it changes duties without a new domestic law is unclear as of 29 October 2026.[2]

AAIP guide to using AI responsibly

Draft2024Published as a preliminary version for comment until 30 October 2024. It recommends impact assessments, explainability, security measures and checks at each stage of the AI life cycle. It is guidance, not a binding rule, and whether a final version replaced it is unclear as of 29 October 2026.[4]

    Where AI fits first

    Where AI fits first

    Banking and fintech

Fraud detection and Spanish-language customer service, with staff reviewing credit decisions.

Law 25.326 article 12 limits sending customer data to countries without adequate protection, which matters for foreign AI services. Check Central Bank rules for outsourcing and technology risk.

    Health care

Summarising clinical notes and appointment handling, with clinicians making decisions.

Health data is sensitive data under article 2 of Law 25.326, so consent and security need extra care.[1]

    Agribusiness

Crop and weather forecasting and document processing for exports, using mostly non-personal data.

We found no AI rule specific to agriculture. Data protection law applies only where personal data is used.

    Public sector

Handling citizen requests and searching case files.

Disposición 2/2023 gives public bodies recommendations for each stage of an AI project. Article 20 of Law 25.326 bars administrative acts assessing conduct based only on automated processing.[5]

    Your first steps

    Your first steps

    1. Check whether your databases must be registered with the AAIP, and register them before adding AI.
    2. Record the consent or exception you rely on for each AI use of personal data, as Law 25.326 makes consent the default.
    3. Map where personal data goes, including foreign AI and cloud providers, and confirm the destination meets article 12.
    4. Run an impact assessment before deploying AI on personal data, as the AAIP guide recommends.
    5. Keep a person in the loop for decisions that assess someone's conduct or creditworthiness.
    6. Prepare an incident response process, since Convention 108+ points towards mandatory incident reporting.
    7. Follow the data protection and AI bills in Congress, as a new law could change these steps.

    How we work with you

We work remotely with clients worldwide, in the client's time zone. Argentina is on UTC-3 and India on UTC+5:30, so India is 8.5 hours ahead. With a 9:00 to 18:00 day in Argentina and 9:30 to 18:30 in India, the overlap is only 1 hour: 09:00 to 10:00 in Buenos Aires, which is 17:30 to 18:30 in India. So we agree a fixed early-morning (Argentina) and evening (India) call window, and send written updates at the end of each Indian day so work is ready when your morning starts.

    Questions

Common questions about AI in Argentina

Does Argentina have an AI law?

Not as of 29 October 2026. Several AI bills have been filed in Congress, and we found none that has passed. Law 25.326 and AAIP guidance apply in the meantime.

Can we use a foreign AI service with customer data?

Law 25.326 prohibits transfers to countries without adequate protection, with narrow exceptions. Check whether the provider's country is considered adequate, or which safeguard or exception applies, before sending personal data.

Is the AAIP AI guide binding?

No. It is guidance that recommends impact assessments, explainability and security measures. Law 25.326 is what the AAIP enforces, and following the guide helps show care.

Will the data protection law change?

Probably, but the timing is unclear as of 29 October 2026. Argentina approved Convention 108+ in 2022, and bills to replace Law 25.326 have been filed, but none has passed.
