AI in Jamaica: the rules, the readiness and where to start

    Last checked: 29 October 2026

What should a company in Jamaica know before starting with AI?

Jamaica has no AI law as of 29 October 2026. The Data Protection Act, 2020, in force since 1 December 2023, is the law that applies to AI today: data controllers must register with the Office of the Information Commissioner, and people can object to significant decisions made solely by automated means. A National AI Policy is being drafted after a UNESCO readiness assessment launched in April 2026.

    Why now

    Why Jamaica is worth watching

Each point links to the document it comes from.
    • The Data Protection Act took effect on 1 December 2023, and data controllers had to register with the OIC and pay an annual fee from that date.[2]

    • The government launched its UNESCO AI Readiness Assessment report on 1 April 2026, with input from more than 196 people.[3]

    • The assessment reports internet penetration of 85 percent and calls for AI legislation on algorithmic accountability, bias and explainability.[3]

    • A National AI Task Force formed in August 2023 delivered policy recommendations in September 2024, and drafting of a National AI Policy is under way.[3]

    • The government announced mandatory AI training for public-sector employees in June 2026, and no AI bill had been tabled by September 2026.[5]

    The rules

The rules that matter for AI

What each law or policy means when you build or buy an AI system.

Data Protection Act, 2020: registration, rights and automated decisions

In force2020A data controller may not process personal data unless it is registered with the Commissioner (section 15). A person can require that significant decisions about them, such as on work performance, creditworthiness or reliability, are not based solely on automated processing; if such a decision is made, they must be told and can ask for it to be reconsidered within 30 days (section 12).[1]

Data Protection Act, 2020: breaches, transfers and penalties

In force2020Controllers must report security breaches affecting personal data to the Commissioner within 72 hours of becoming aware (section 21). Data may only go to a country outside Jamaica that ensures adequate protection, unless an exception applies (section 31). Controllers submit an annual data protection impact assessment (section 45), and a company convicted of an offence can be fined up to 4% of annual gross worldwide turnover (section 68).[1]

    Cybercrimes (Amendment) Act, 2026

Passed, not yet in force2026Passed by the House in February 2026 and the Senate in May 2026, according to the Oxford AI Justice Atlas, which does not say whether it is in force. It targets non-consensual publishing of intimate content. It does not mention AI or deepfakes, and the minister described the Act as technology-neutral.[5]

    Where AI fits first

    Where AI fits first

    Banking and credit

Fraud alerts, document checks and customer service, with staff deciding on credit.

Creditworthiness is named in section 12 of the Data Protection Act, so customers can object to fully automated credit decisions.[1]

    Tourism

Guest messaging, booking support and demand forecasting.

The UNESCO assessment names tourism as a sector where AI can raise productivity. Guest data sent to platforms abroad must meet the adequacy rule in section 31.[3]

    Health care

Drafting clinical notes and scheduling, with clinicians making decisions.

Health care is a priority sector in the UNESCO assessment. Health data is sensitive personal data under the Act, with its own processing conditions.[3]

    Business process outsourcing

Call summaries, quality review and agent assist tools.

Processing on behalf of overseas clients still needs registration, security and transfer checks under the Act.[1]

    Your first steps

    Your first steps

    1. Confirm you are registered with the OIC as a data controller before any AI system processes personal data.
    2. Appoint a data protection officer if the Act requires one for your organisation.
    3. List decisions your AI makes about people, such as credit or job screening, and set up the notice and 30-day reconsideration process.
    4. Check that any country where your AI provider stores data offers adequate protection, or that an exception applies.
    5. Prepare a breach process that can report to the Commissioner within 72 hours.
    6. Include AI tools in your annual data protection impact assessment.
    7. Follow the National AI Policy consultation and respond if it affects your sector.
