AI in Botswana: the rules, the readiness and where to start

    Last checked: 29 October 2026

What should a company in Botswana know before starting with AI?

Botswana has no dedicated AI law as of 29 October 2026. The Data Protection Act, 2024 came into force on 14 January 2025 and is the law that applies to AI today. A company should check which automated decisions affect people, plan for 72-hour breach notice, and confirm how any data sent abroad is protected.

    Why now

    Why Botswana is worth watching

Each point links to the document it comes from.
    • The Data Protection Act, 2024 came into operation on 14 January 2025 under S.I. No. 4 of 2025.[1]

    • The 2024 Act repealed the 2018 Act, which never came into force because its start date was repeatedly extended.[4]

    • In May 2025 a stakeholder workshop validated Botswana's AI readiness report, prepared with UNESCO's Readiness Assessment Methodology, to inform national AI policy.[6]

    • In August 2025 the Assistant Minister of Communications and Innovation said the government was finalising a National AI Policy covering health care, agriculture, education and governance.[5]

    • The 2024 Act reaches organisations outside Botswana that offer goods or services to people in Botswana or monitor their behaviour.[3]

    The rules

The rules that matter for AI

What each law or policy means when you build or buy an AI system.

Data Protection Act, 2024: automated decisions, impact assessments and breaches

In force2024In the Bill as published, people have the right not to be subject to a decision based solely on automated processing, including profiling, with legal or significant effects, unless it rests on a contract, explicit consent or a law; even then they can get human intervention and contest it. An impact assessment is required for high-risk processing such as automated profiling. Breaches go to the Commission within 72 hours where feasible, which a law firm confirms for the enacted Act.[2]

Data Protection Act, 2024: transfers, DPOs and fines

In force2024Transfers abroad need an adequacy decision, safeguards such as standard clauses or binding corporate rules, or a listed exception. A law firm reports that the enacted Act also requires a copy of transferred data to be kept in Botswana. A data protection officer is mandatory for large-scale sensitive data and systematic monitoring. The Bill set fines of up to P50 million or 4% of worldwide turnover, whichever is higher, for the most serious breaches.[3]

    National Artificial Intelligence Policy

Draft2025The government said in August 2025 that it was finalising the policy. We found no published final version as of 29 October 2026. It would be a policy, not a law.[5]

    Where AI fits first

    Where AI fits first

    Banking and finance

Fraud detection, credit review with human sign-off, and customer service chat.

Automated credit decisions bring in the right to human intervention and may need an impact assessment.[2]

    Health care

Summarising patient records and triage support, with clinicians making decisions.

Health care is a sector named for the draft AI policy. Large-scale health data processing triggers DPO and impact assessment duties.[5]

    Agriculture

Livestock and crop monitoring and advice for farmers.

Agriculture is named for the draft AI policy. We found no AI rule specific to agriculture.[5]

    Education

Personalised learning support and administrative drafting, with teachers in charge.

Education is named for the draft AI policy and was a government AI priority area in 2023.[7]

    Your first steps

    Your first steps

    1. Read the Data Protection Act, 2024 and confirm your duties under it, since it has applied since 14 January 2025.
    2. List each automated decision that affects people significantly and add a way to get human review and contest it.
    3. Run an impact assessment before AI that profiles people or uses sensitive data at scale.
    4. Map any data leaving Botswana, put safeguards such as standard clauses in place, and check whether a local copy must be kept.
    5. Set up a breach process that can notify the Commission within 72 hours.
    6. Appoint a data protection officer if you process sensitive data at scale or monitor people systematically.
    7. Watch for the National AI Policy from the Ministry of Communications and Innovation.

    Questions

Common questions about AI in Botswana

Does Botswana have an AI law?

Not as of 29 October 2026. The government said in August 2025 that a National AI Policy was being finalised. The Data Protection Act, 2024 applies to AI that uses personal data.

When did the new data protection law start?

On 14 January 2025, under the Data Protection Act (Date of Commencement) Order, 2025. Some law firm notes give 29 October 2024, which is when the Act was passed, not when it started.

How fast must I report a data breach?

Within 72 hours of becoming aware of it, where feasible, to the Information and Data Protection Commission. A late notice must give reasons for the delay.

    What are the fines?

The Bill set administrative fines of up to P50 million, or 4% of worldwide annual turnover for an undertaking, whichever is higher, for the most serious breaches. A law firm reports the enacted Act raised the maximum to P50 million.
