AI in Ghana: the rules, the readiness and where to start

    Last checked: 29 October 2026

What should a company in Ghana know before starting with AI?

Ghana has no AI law as of 29 October 2026. The Data Protection Act, 2012 (Act 843) applies to AI that uses personal data: register with the Data Protection Commission, have consent or another lawful ground, and respect people's right to challenge decisions taken only by automatic means. A new Data Protection Bill and a Bank of Ghana AI directive are both still being prepared.

    Why now

    Why Ghana is worth watching

Each point links to the document it comes from.
    • President Mahama launched Ghana's National AI Strategy in Accra on 24 April 2026, naming education, health care, agriculture, finance and public services as target sectors.[5]

    • The launch stressed localising AI for Ghanaian languages such as Twi, Ga, Ewe and Dagbani, and pointed to the One Million Coders Programme for digital skills.[5]

    • The communications minister said in April 2026 that Cabinet had approved a $250 million investment in a national AI computer centre.[6]

    • A draft Data Protection Bill, 2025 went to public consultation from 20 to 31 October 2025. It would replace Act 843 and create a Data Protection Authority.[3]

    • The Bank of Ghana governor said in October 2026 that the central bank is developing a directive on AI use in the financial sector.[7]

    The rules

The rules that matter for AI

What each law or policy means when you build or buy an AI system.

Data Protection Act, 2012 (Act 843)

In force2012Processing needs prior consent unless a listed ground applies, such as a contract, a legal duty or a legitimate interest, and people may object (section 20). A person can require that a decision which significantly affects them is not based solely on automatic processing. If it is, they must be told and can ask for it to be reconsidered within 21 days, with exceptions for contracts and legal authority (section 41). Data on health, religion, ethnicity and children under parental control is special personal data and is restricted (section 37).[1]

Act 843: registration, breaches and penalties

In force2012A data controller must register with the Commission before processing (sections 27 and 53) and renew every two years (section 50). The application must name the countries the data may go to (section 47). Breaches must be reported to the Commission and the person as soon as reasonably practicable (section 31). Processing without registration can mean up to 250 penalty units or two years in prison (section 56).[1]

    Data Protection Bill, 2025

Draft2025The draft would set up a Data Protection Authority, add data protection impact assessments and keep rights on automated decision-taking, and it would repeal Act 843. In March 2026 it was reported as about to go to Parliament. We found no record of it passing, so status is unclear as of 29 October 2026.[2]

    Where AI fits first

    Where AI fits first

    Banking and mobile money

Fraud detection, credit assessment support and customer service chatbots.

The Bank of Ghana is developing an AI directive and named credit assessment, fraud detection and customer service as uses. If a credit decision is fully automated, section 41 of Act 843 applies.[7]

    Agriculture

Advice to farmers in local languages and crop disease checks from photos.

Agriculture is a target sector of the National AI Strategy. Farm and weather data that does not identify people is outside Act 843.[5]

    Health care

Clinical note summaries and appointment support, with clinicians making decisions.

Health data is special personal data under section 37 of Act 843 and can be processed only in the cases the Act allows.[1]

    Public services and education

English and local-language assistants for citizen services and learning.

The strategy launch mentioned performance indicators for ministries and agencies to measure AI adoption.[5]

    Your first steps

    Your first steps

    1. Register with the Data Protection Commission before processing personal data, list the countries your AI vendor may send data to, and renew every two years.
    2. Record the consent or other section 20 ground for each AI use, and set up a way to handle objections.
    3. For any decision made only by a model that significantly affects a person, tell them and be ready to reconsider within 21 days (section 41).
    4. Keep health, religious, ethnic and children's data out of AI projects unless the Act allows it.
    5. Use the DPC's breach report form and set up a process to notify the Commission and affected people quickly.
    6. If you are a bank or fintech, follow the Bank of Ghana's AI directive as it develops.
    7. Read the draft Data Protection Bill now, since it adds impact assessments and a new regulator.

    Questions

Common questions about AI in Ghana

Does Ghana have an AI law?

No, not as of 29 October 2026. Ghana launched a National AI Strategy in April 2026, which is a policy. In March 2026 the DPC's executive director said a new bill would cover AI, automated decision-making and cross-border transfers; we found no record of it passing.

Do I need to register before using AI on customer data?

Yes, if you process personal data as a data controller. Act 843 says an unregistered controller shall not process personal data, and registration must be renewed every two years.

Can a model approve or reject loan applications on its own?

Section 41 lets people require that significant decisions are not based solely on automatic processing, and to ask for reconsideration. Decisions made when entering or performing a contract are exempt, but keeping a human review is safer.

Is the new Data Protection Bill law yet?

Not as far as we could find. It went to consultation in October 2025 and was reported in March 2026 as about to go to Parliament. Act 843 still applies.
