AI in Zambia: the rules, the readiness and where to start

    Last checked: 29 October 2026

What should a company in Zambia know before starting with AI?

Zambia has no dedicated AI law as of 29 October 2026. The Data Protection Act, No. 3 of 2021 is the law that applies to AI today, and it is strict: data must be stored in Zambia unless the Minister allows otherwise, and breaches must be reported within 24 hours. A company should register with the Office of the Data Protection Commissioner, check where its AI tools keep data, and run an impact assessment before automated decisions about people.

    Why now

    Why Zambia is worth watching

Each point links to the document it comes from.
    • The Ministry of Technology and Science launched the National AI Strategy in November 2024, with support from Finland and the Tony Blair Institute.[4]

    • The strategy proposes a National AI Council and sector working groups, and plans to extend ZICTA's mandate to cover AI regulation and ethical compliance.[2]

    • The strategy names priority sectors including healthcare, agriculture, education, mining and finance.[2]

    • The ODPC runs online registration for data controllers and processors and set a registration deadline of 30 April 2025.[5]

    • The strategy itself describes Zambia's AI ecosystem as early stage, driven mainly by private firms and start-ups, with activity in health, mining and financial services.[2]

    The rules

The rules that matter for AI

What each law or policy means when you build or buy an AI system.

Data Protection Act, No. 3 of 2021: automated decisions, impact assessments and breaches

In force2021People must not be subject to a decision based solely on automated processing, including profiling, with legal or similar effects, unless it rests on a contract, a law or explicit consent; even then they must be able to get human intervention and contest it (section 62). Automated processing of sensitive data needs express consent or another listed ground. An impact assessment is required before automated decisions with significant effects, large-scale sensitive data or large-scale public monitoring (section 46). Breaches go to the Commissioner within 24 hours (section 49).[1]

Data Protection Act, No. 3 of 2021: registration, local storage and penalties

In force2021No one may control or process personal data without registering (section 19). Personal data must be processed and stored on a server or data centre in Zambia, unless the Minister prescribes categories that may be stored abroad, and sensitive data must always stay in Zambia (section 70). Transfers abroad need consent plus approved contracts or ministerial approval, or Commissioner approval (section 71). Companies face fines of 2% of annual turnover or a set number of penalty units, whichever is higher (sections 18 and 55).[1]

    National Artificial Intelligence Strategy

In force2024This is a government strategy, not a law, so it does not create duties for companies on its own. Its cover says 2024 to 2026, while its page headers say 2025 to 2027. The proposed extension of ZICTA's mandate to AI would need further steps, and we found no sign it has happened as of 29 October 2026.[2]

    Where AI fits first

    Where AI fits first

    Mining

Predictive maintenance, geological data analysis and safety monitoring.

A priority sector in the AI strategy. Monitoring of workers is personal data processing and may need an impact assessment.[2]

    Banking and insurance

Fraud detection and credit or claims review with a human route to contest.

Section 62 gives people the right to human intervention on automated decisions. Finance is a priority sector in the strategy.[1]

    Agriculture

Crop advice and yield forecasting for farmers.

The strategy names precision agriculture and mentions the Farmer Input Support Programme. We found no AI rule specific to agriculture.[2]

    Health care

Diagnostic support and record summaries, with clinicians making decisions.

Health data is sensitive and must be processed and stored in Zambia under section 70(3).[1]

    Your first steps

    Your first steps

    1. Register with the ODPC as a data controller or processor, and confirm the renewal period with the ODPC.
    2. Find out where your AI tools store and process data. Keep sensitive data on servers in Zambia, and check whether other data is in a category allowed abroad.
    3. Run a data protection impact assessment before any automated decision that affects people significantly.
    4. Give people a way to get human review and contest automated decisions.
    5. Set up a breach process that can notify the Commissioner within 24 hours and tell affected people as soon as practicable.
    6. Appoint a data protection officer, as section 48 requires.
    7. Follow ZICTA and the Ministry of Technology and Science for any AI rules under the strategy.
